Please read these Terms of Service ("Terms") carefully before using EstateVis ("Service"), operated by EstateVis ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

EstateVis is an AI-powered platform that helps real estate professionals generate content optimized for AI search visibility (GEO), automate content workflows, and track content performance. The Service uses artificial intelligence to generate draft content based on user-provided inputs.

2. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 18 years old, have the legal authority to enter into these Terms, and agree to comply with them. If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

3. Use of the Service

You agree to use EstateVis only for lawful purposes. You must not:

Use the Service to generate content that is false, misleading, defamatory, or fraudulent
Use the Service in any way that violates applicable laws, including fair housing laws, MLS rules, or real estate regulations
Attempt to reverse engineer, copy, or redistribute any part of the Service
Use the Service to generate spam or unsolicited commercial communications in violation of applicable law
Share your access credentials with others
Use automated tools to make excessive API requests that place unreasonable load on our infrastructure

4. AI-Generated Content Disclaimer

All content generated by EstateVis is produced by artificial intelligence and is provided as a draft starting point only. You are solely responsible for reviewing, editing, and verifying all generated content before use. EstateVis makes no warranty that generated content is accurate, complete, legally compliant, or suitable for any particular purpose.

You acknowledge that AI-generated content may contain errors, inaccuracies, or inappropriate material. Always review content before publishing or sending it. EstateVis is not responsible for any consequences arising from your use of generated content.

5. Real Estate Compliance

You are solely responsible for ensuring that all content you publish or send complies with applicable laws and regulations, including but not limited to: the Fair Housing Act, MLS rules and regulations, state real estate licensing laws, CAN-SPAM Act and other anti-spam laws, and any other applicable federal, state, or local regulations. EstateVis is not a licensed real estate brokerage, attorney, or compliance advisor.

6. GEO and Search Visibility

EstateVis generates content designed to improve your visibility in AI-powered search engines (Generative Engine Optimization). We make no guarantee that using our content will result in citations by any specific AI system, improved search rankings, or increased leads. Results vary based on market, competition, publishing frequency, and factors outside our control.

7. Subscription and Billing

Paid subscriptions are billed in advance on a monthly or annual basis. Subscriptions automatically renew unless cancelled before the renewal date. Monthly subscribers may cancel at any time and retain access through the end of the current billing period. Annual subscribers may request a full refund within 30 days of purchase. All payments are processed by Stripe. We reserve the right to change pricing with 30 days' notice.

8. Intellectual Property

You retain ownership of all content you input into the Service and all content generated for you by the Service. By using the Service, you grant us a limited license to process your inputs solely for the purpose of providing the Service. We retain all rights to the EstateVis platform, software, and brand.

9. Limitation of Liability

To the fullest extent permitted by law, EstateVis and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the three months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of Hawaii, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Hawaii.
